Terms and conditions
1. Booking & Payment
1.1 A 50% non-refundable deposit is required to secure your photoshoot date.
1.2 The remaining 50% is due before the photoshoot takes place.
1.3 Payment is accepted by online bank transfer (details provided upon request), cash, or cheque. Cheques must clear before the photoshoot date.
1.4 Failure to pay the balance prior to the session will result in cancellation of the booking without refund of the deposit.

2. Client Punctuality & Cooperation
2.1 It is the client’s responsibility to arrive on time and at the correct location. Lost time due to lateness cannot be made up or refunded.
2.2 Clients are encouraged to arrive a few minutes early to discuss arrangements and ask any questions.
2.3 The client agrees to cooperate with the photographer, including following posing guidance, identifying people or scenes to be photographed, and assisting where needed.
2.4 The client shall reimburse the photographer for any damages to props or equipment caused by the client’s negligence.

3. Artistic Style & Creative Licence
3.1 The client acknowledges that photography is a creative service and that Lucia Dickson Photography works in a distinctive artistic style.
3.2 The photographer retains full creative control over pose direction, composition, colour grading, editing style, and artistic interpretation.
3.3 The photographer will deliver images consistent with her portfolio. Specific editing requests or stylistic changes are not guaranteed unless agreed in writing before the session.
3.4 Creative dissatisfaction is not grounds for refunds, reshoots, or fee reductions.

4. Editing, Image Delivery & Revisions
4.1 Editing will take between 7–14 days, unless otherwise stated.
4.2 If delays occur due to genuine unforeseen circumstances, the client will be informed, but no compensation is offered for delays.
4.3 Images are delivered via a secure online gallery unless another method is agreed.
4.4 The gallery is password-protected. The photographer is not responsible for security issues arising from the client sharing the password.
4.5 Additional or specialised retouching requests may incur extra fees, at the photographer’s discretion.

5. Copyright & Usage Rights
5.1 The photographer retains full copyright to all images.
5.2 The client is granted non-exclusive, unlimited personal-use rights for the images they have paid for.
5.3 The photographer may use images for portfolio, website, social media, advertising, exhibitions, and promotional use, without naming the client, unless a written privacy agreement is made before the session.

6. Image Storage
6.1 Images are stored for 2 years from the session date.
6.2 After 2 years, images may be deleted at the photographer’s discretion.

7. Cancellations & Rescheduling
7.1 The deposit is non-refundable under Isle of Man consumer law, as photography is a bespoke creative service, unless the photographer cancels.
7.2 Clients may reschedule up to 48 hours before their session.
7.3 Rescheduling within 48 hours may incur a fee due to loss of the reserved slot.
7.4 If the client cancels at any time, the deposit is retained.
7.5 If the photographer cancels due to illness, injury, or emergency, the client may choose:
• A rescheduled date, or
• A full refund of all fees paid.
7.6 If weather conditions make the session unsafe or impossible, the photographer will offer a rescheduled date.

8. Liability & Safety
8.1 The photographer is not liable for injuries, accidents, allergic reactions, or incidents occurring during the photoshoot.
8.2 The photographer is not responsible for lost, damaged, or stolen personal items.
8.3 The client is responsible for their own safety and the safety of anyone accompanying them.
8.4 The photographer is not liable for colour or print errors caused by third-party printing companies not associated with Lucia Dickson Photography.

9. Force Majeure
9.1 The photographer is not responsible for cancellations or disruptions caused by events beyond her control, including illness, extreme weather, natural disasters, equipment failure, or government restrictions.
9.2 A rescheduled date will be offered where possible.

10. Data Protection (Isle of Man GDPR)
10.1 Personal data is processed in accordance with the Isle of Man Data Protection Act 2018 and IOM GDPR.
10.2 Information is used solely for communication, delivery of images, and internal records.
10.3 The photographer does not sell or share personal information with third parties unless required by law.

11. Reasonable Care & Skill
11.1 The photographer will provide services with reasonable care and skill, as required under Isle of Man consumer protection law.
11.2 Photography is a creative process, and results may vary depending on weather, lighting, location conditions, and client cooperation.

12. Governing Law
This agreement is governed by and interpreted in accordance with the laws of the Isle of Man. Any disputes shall be handled exclusively by the Isle of Man courts.
Nothing in these Terms & Conditions affects the client’s statutory rights under Isle of Man law.

13. Agreement
By booking a session with Lucia Dickson Photography, the client confirms that they have read, understood, and agreed to all Terms & Conditions stated above.

14. Model Release
14.1 The client grants the photographer the irrevocable and unrestricted right to use and publish photographs of the client and/or the client’s party for editorial, trade, advertising, portfolio, website, social media, and any other lawful promotional purposes, without further compensation.
14.2 The client understands that images may be used in both printed and digital formats, and may be cropped, edited, or altered for artistic or promotional purposes.
14.3 The photographer agrees not to use the client’s full name or personal identifying information unless the client gives explicit written permission.
14.4 If the client does not wish their images to be used for promotional purposes, they must state this in writing before the photoshoot. In such cases, the photographer will honour the request and the images will be excluded from marketing material.
14.5 Parents or legal guardians must sign on behalf of minors (under 18 years of age) to grant model release permissions.
14.6 The model release does not affect the client’s personal-use rights to the images as outlined in Section 5.
